What the Policy Actually Does

The moratorium runs for one full school year, 2026-2027, and applies to any software using student-facing generative AI for children from 2-K (a pre-K/kindergarten transitional grade used in NYC) through 8th grade. That covers every elementary and middle school in the system. Teachers can still use AI themselves for lesson planning and administrative tasks, but students in those grades can't interact with it directly in class.

High school looks different. A maximum of 50,000 high schoolers, about 5% of the system, get access to five vetted AI tools through limited pilots: Quill for reading and writing support, Edia for math coaching, Brisk Teaching for guided activities, Playlab for cross-subject assignments, and Intel AI-Ready Schools for semester-long projects. Each tool comes with strict time caps, ranging from 15 to 20 minutes a week depending on the subject, and every pilot runs under a teacher's direct supervision.

All high schoolers, not just those in the pilots, will take two 45-minute AI literacy modules a year covering what generative AI is, where it introduces bias, and how it affects future careers. The policy also sets new screen time caps: 30 minutes a day of 1:1 screen time for grades 3 through 5, and 45 minutes for grades 6 through 8, with second grade and below losing 1:1 screen access almost entirely.

Exceptions exist for students with disabilities, multilingual learners, and kids in career and technical education programs like computer science, where assistive or instructional AI tools remain available regardless of grade. Every technology tool already in use across NYC public schools, not just new AI tools, will also go through a fresh review, and any tool that can't prove it's essential to learning gets removed regardless of how long it's already been sitting in classrooms across the system.

The move follows New York State's earlier restrictions on phones in the classroom, a policy several city and state officials referenced directly when announcing the AI moratorium as the next logical step in the same direction.

Reaction split along familiar lines. A child psychologist told CNBC the policy could be a "home run" for families trying to limit their kids' AI exposure before the technology is fully understood, pointing to the fact that the human prefrontal cortex, the part of the brain responsible for planning and judgment, doesn't finish developing until the mid-twenties. It's about whether the safest response to a fast-moving technology is to slow it down while research catches up, or to teach kids to use it carefully from the start. NYC picked the first option for its youngest students and a narrow, supervised version of the second for its oldest ones. Other districts will make a different call, and parents in both camps have real research behind their position.

What's clear from the reaction alone is that no one, not the mayor's office, not the psychologists quoted in support, not the parents pushing back in other cities, thinks this is a settled question. A full year of data from the country's largest school system will give every other district real evidence to point to, one way or the other, once the coalition's report lands.
